Alabama Supreme Court sides with City of Auburn in short-term rental lawsuit brought by former councilman. Alabama Supreme Court Justices, in a per curiam decision, wrote, "In the present case, Dixon has presented no evidence indicating (1) that the City intended, by not enforcing the previous zoning ordinance against him, to communicate that Dixon would be exempt from any future ordinance's regulation of short-term rentals or (2) that he relied on the City's alleged enforcement inaction before commencing his short term-rental use of the home's basement." New Orleans short-term rental rule struck down by court. A key provision of a city law restricting short term, Airbnb-style rentals in New Orleans has been ruled unconstitutional by a federal appeals court. The provision effectively limits short-term rental licenses to people living in the city. The 5th U.S. Circuit Court of Appeals ruled that the provision unconstitutionally excludes out-of-state property owners from having licenses. Council temporarily bans new short-term rentals as it rewrites regulations. (2022)
